By accessing and using GameFest Canada's website, participating in our exhibition, or attending our events, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms apply to all visitors, users, exhibitors, and others who access or use our services.

We reserve the right to modify these terms at any time without prior notice. Your continued use of our services following the posting of changes constitutes your acceptance of such changes. It is your responsibility to review these terms periodically for updates.

2. Event Participation and Registration

Registration for GameFest Canada events is subject to availability and acceptance of these terms. All registration information must be accurate, current, and complete. You are responsible for maintaining the confidentiality of your registration details and account information.

Event tickets and registration confirmations are non-transferable unless explicitly stated otherwise. We reserve the right to refuse registration or attendance to anyone at our sole discretion. Refund policies for event registration fees are outlined in our separate refund policy document.

By registering for our events, you grant permission for GameFest Canada to use your name, likeness, and any content you create or submit during the event for promotional purposes across various media channels.

3. Intellectual Property Rights

All content on the GameFest Canada website, including but not limited to text, graphics, logos, images, audio clips, video content, and software, is the property of GameFest Canada or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

Users may not reproduce, distribute, display, sell, lease, transmit, or otherwise exploit any content for any other purposes without the prior written consent of GameFest Canada or the respective copyright owner. You may download or copy content only for personal, non-commercial use, provided you keep intact all copyright and other proprietary notices.

Game developers and exhibitors retain ownership of their intellectual property while granting GameFest Canada limited rights to showcase and promote their work during and after the exhibition for marketing and educational purposes.

4. User Conduct and Prohibited Activities

All participants must conduct themselves in a professional and respectful manner. Harassment, discrimination, or inappropriate behavior of any kind will not be tolerated and may result in immediate removal from the event without refund.

Prohibited activities include but are not limited to: disrupting presentations or workshops, distributing unauthorized promotional materials, engaging in any illegal activities, violating intellectual property rights, or behaving in a manner that could damage GameFest Canada's reputation or harm other participants.

Users are responsible for their own equipment and personal belongings. GameFest Canada is not liable for any loss, theft, or damage to personal property during events. All participants must comply with venue rules and local laws and regulations.

5. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

We implement appropriate security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal information. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount you paid to GameFest Canada for the specific service or event in question during the twelve months preceding the claim.

We do not warrant that our services will be uninterrupted, timely, secure, or error-free. We make no warranties regarding the results that may be obtained from the use of our services or the accuracy or reliability of any information obtained through our services.

7. Event Changes and Cancellations

GameFest Canada reserves the right to modify, postpone, or cancel events at any time due to circumstances beyond our control, including but not limited to natural disasters, government regulations, venue unavailability, or insufficient registration numbers.

In the event of cancellation, we will provide reasonable notice when possible and offer appropriate remedies, which may include rescheduling, partial refunds, or credits toward future events, depending on the circumstances and timing of the cancellation.

Force majeure events, including but not limited to acts of God, war, terrorism, pandemic, or government action, may result in event modifications or cancellations without liability to GameFest Canada beyond reasonable refund policies.

8. Third-Party Content and Links

Our website and events may contain links to third-party websites, services, or content that are not owned or controlled by GameFest Canada. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

You acknowledge and agree that GameFest Canada shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any third-party content, goods, or services available through such links.

9. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

Before pursuing formal legal action, we encourage users to contact us directly to resolve any disputes or concerns. We are committed to working with our community to address issues fairly and promptly through good faith communication.

If legal action becomes necessary, both parties agree to seek resolution through binding arbitration when possible, following the rules of the applicable arbitration association in Ontario, Canada.

No waiver of any provision of these terms shall be deemed a further or continuing waiver of such provision or any other provision, and GameFest Canada's failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.
